Terms of Use

These Terms of Use govern your access to and use of the website and online shop at jakobgrosseophoff.com, in accordance with German law, including the German Civil Code (Bürgerliches Gesetzbuch – BGB) and the German Commercial Code (Handelsgesetzbuch – HGB).

1. Scope and Acceptance

1.1 These Terms apply to the website, online shop purchases, and services offered, including auctions.
1.2 By using the website, registering an account, placing an order, or a bid, you confirm that you have read and understood these Terms and the auction catalog PDF in full (see § 305 BGB on incorporation of terms).

3. Website Content and Intellectual Property

3.1 All content – images, texts, designs, and code – is protected under §§ 1–60 UrhG (German Copyright Act) and may not be reproduced without written consent.
3.2 Personal, non-commercial use (viewing/downloading) is permitted; any further use requires explicit permission.

4. Purchases in the Online Shop

4.1 Pricing & VAT: Prices are inclusive of VAT per § 19 UStG. Displayed in EUR.
4.2 Orders: Binding upon confirmation in accordance with § 433 and § 147 BGB.
4.3 Payment Methods: Credit card via Stripe (other methods by arrangement).
4.4 Payment Deadline: Full payment due before shipment (§ 271 BGB).
4.5 Shipping & Delivery: As stated per product; delivery times are estimates (see § 271 BGB).
4.6 Right of Withdrawal: Consumers under §§ 355 ff. BGB have a 14-day withdrawal right, except for custom-made items per § 312g Abs. 2 Nr. 1 BGB.

5. Liability and Warranty

5.1 Liability is excluded for slight negligence except in cases of injury to life, body, or health, per §§ 276, 278, 831 BGB and § 309 Nr. 7 BGB.
5.2 Statutory warranty applies pursuant to §§ 434–443 BGB; for second-hand goods, limitation period per § 438 BGB.
5.3 Further contractual or tortuous liability is limited to foreseeable damage typical of the contract, unless mandatory law dictates otherwise.

6. Privacy and Data Protection

6.1 Personal data is processed under Art. 6 GDPR and § 25 BDSG solely for order and auction processing.
6.2 Data will not be shared with third parties without explicit consent.
6.3 By using the website or bidding, you consent to this processing as required by Art. 7 GDPR.

7. Applicable Law and Jurisdiction

7.1 These Terms are governed by German law, excluding UN sales law (CISG).
7.2 Place of jurisdiction is Rostock, Germany, in accordance with § 38 GVG and § 293 ZPO.


 

Auction Terms & Conditions

These conditions apply to participation in online auctions.

  1. Catalog Confirmation
    By submitting a bid, you confirm that you have read the auction catalog (PDF) in its entirety and agree to all conditions stated therein.

  2. Binding Bids
    Each bid submitted is binding. A binding purchase contract is formed upon award of the lot.

  3. Auction Process

  • All bids are placed online via jakobgrosseophoff.com/auctions.

  • The auction uses a soft closing mechanism: if a bid is placed within the last 5 minutes, the auction is automatically extended by 5 minutes. This prevents so-called “sniping” (last-second bids) and ensures a fair chance for all bidders.

  1. Payment

  • To participate in the auction, you must register and provide your credit card information.

  • Upon successful award, the corresponding amount will be automatically charged to the registered credit card via Stripe.

  • No separate settlement is necessary.

  1. Shipping, Insurance, and Liability
    Please refer to the “Shipping Options” section in the auction catalog (PDF). Buyers are responsible for shipping, insurance, and any applicable customs duties.

  2. Right of Withdrawal
    Auction purchases are excluded from the statutory right of withdrawal pursuant to § 312g (2) no. 10 BGB.
